TLR Foundation Releases Nationwide Analysis of Carbon Capture Liability Regulations
AUSTIN—The Texans for Lawsuit Reform (TLR) Foundation, the non-partisan legal research affiliate of TLR, today released its latest research paper, Liability Protection for Carbon Dioxide Sequestration in Texas. The paper studies existing regulations throughout the nation concerning the capture and storage of CO2 to inform the public and policymakers on liability issues related to carbon capture, transportation and storage.
“Texas is the nation’s leading oil and gas producer and one of the world’s largest manufacturing hubs,” TLR Foundation General Counsel Lee Parsley said. “Texans have unsurpassed expertise in mining and manufacturing and it is expected that lawmakers will discuss the future of carbon capture, transportation and storage in the 88th Legislature. We hope this paper will help inform conversations about how best to address related liability issues in Texas.”
As the foundation’s paper describes, a number of states in the U.S. already have CO2 storage facilities operating under state regulations. All of these states have enacted plans for transferring title, responsibility, management and liability of underground CO2 storage facilities to the state after a certain amount of time. Some states have other measures to prevent unwarranted litigation against companies engaged in capturing and storing CO2.
